Call to Protect Religious Freedom Under Section 116 in Australia

The Muslim Legal Network of WA has called on the Australian Government, along with State and Territory authorities, to uphold the constitutional rights of all Australians to freedom of religion under Section 116 of the Australian Constitution.
The statement emphasizes that peaceful religious gatherings and prayer events, especially those held in times of grief, should not be subject to condemnation or criminalisation. Instead, authorities are urged to respect and protect the rights of individuals to practise their religion freely.
The release also highlights concerns regarding international law, including issues surrounding unlawful acts of war and actions against global leaders. It stresses that such global developments have local consequences, particularly affecting communities expressing grief and solidarity.
For many Shi’a Muslims around the world, including those in Australia, Ayatollah Ali Khamenei was not only a political figure but also a highly respected religious leader. His passing has deeply impacted these communities, and their commemorations reflect genuine grief and religious expression.
The Muslim Legal Network of WA warns that targeting any religious group in this manner represents a broader threat to the fundamental freedoms guaranteed by the constitution. Protecting religious liberty remains essential to maintaining a truly free and democratic society.
